पटना : बिहार सरकार को आरक्षण मामले पर पटना हाई कोर्ट ने बड़ा झटका दिया है.दरअसल जातीय जनगणना के बाद बिहार सरकार के द्वारा आरक्षण की सीमा बढ़ाई जाने के फ़ैसले को पटना हाई कोर्ट ने रद्द कर दिया. पटना हाई कोर्ट के फैसले के बाद पहले से निर्धारित आरक्षण की सीमा ही बिहार में लागू रहेंगी. जातीय जनगणना के बाद राज्य में आरक्षण की सीमा को बढ़ा दिया गया था. बिहार में आरक्षण की सीमा 50 फीसदी से बढ़ाकर 65 फीसदी कर दी थी. जिसे अब हाई कोर्ट की तरफ से रद्द कर दिया गया.

पटना हाई कोर्ट का मानना है कि आरक्षण की जो सीमा पहले से ही निर्धारित है, उसे बढ़ाया नहीं जा सकता है. ये मामला संवैधानिक है, इसलिए इस मामले पर आगे सुनवाई होगी. सुनवाई के बाद ही इस मामले पर कोई अंतिम फैसला लिया जाएगा. अधिवक्ता गौरव ने कहा कि इस याचिका को सुनने के बाद पटना हाई कोर्ट के मुख्य न्यायाधीश ने माना कि ये निर्णय नियमावली के खिलाफ है. हालांकि बिहार सरकार इस मामले को सुप्रीम कोर्ट लेकर जा सकती है, जहां इस मामले में सुनवाई होगी.

हाई कोर्ट ने कहा कि अगर आरक्षण की सीमा बढ़ाने की जरूरत पड़ेगी तो ये संवैधानिक बेंच ही तय करेंगी. जिससे ये साफ हो गया है कि ये मामला सुप्रीम कोर्ट की बेंच के पास जाएगा. जहां बेंच ये फैसला करेगी कि बिहार सरकार क्या आरक्षण की सीमा बढा सकती है या नहीं. नीतीश सरकार ने चुनाव से पहले ही आरक्षण सीमा बढ़ा दी थी, ऐसे में उन्हें इसका चुनावी फायदा मिलने की भी बात कही जा रही है.

इस मामले पर बिहार में जमकर सियासत भी हुई. सुप्रीम कोर्ट के वकील अश्विनी दुबे ने कहा कि अब इस मामले में बिहार सरकार ऊपरी अदालत जा सकती है, जो कि उनका अधिकार है. लेकिन बेसिक सवाल ये है कि जो आरक्षण बढ़ाया गया था, वो संविधान के अनुच्छेद 14, 15 और 16 से विपरीत था. इंदिरा साहनी केस में ये तय कर दिया गया कि किसी भी परिस्थिति में तीन कैटेगरी एससी, एसटी और ओबीसी के लिए इसे 50 फीसदी से ज्यादा नहीं किया जा सकता.

After the decision of Patna High Court, only the previously determined reservation limit will be applicable in Bihar. After the caste census, the reservation limit in the state was increased. The reservation limit in Bihar was increased from 50 percent to 65 percent. Which has now been canceled by the High Court.

Patna High Court believes that the reservation limit which is already determined cannot be increased. This matter is constitutional, so there will be further hearing on this matter. Any final decision on this matter will be taken only after the hearing. Advocate Gaurav said that after hearing this petition, the Chief Justice of Patna High Court admitted that this decision is against the rules. However, the Bihar government can take this matter to the Supreme Court, where the matter will be heard.

The High Court said that if there is a need to increase the reservation limit, then it will be decided by the constitutional bench. Due to which it is clear that this matter will go to the Supreme Court bench. Where the bench will decide whether the Bihar government can increase the reservation limit or not. Nitish government had increased the reservation limit before the elections, so it is also being said that they will get electoral benefit from it.

There was a lot of politics in Bihar on this matter. Supreme Court lawyer Ashwini Dubey said that now the Bihar government can go to the higher court in this matter, which is their right. But the basic question is that the reservation that was increased was against Articles 14, 15 and 16 of the Constitution. In the Indira Sahni case, it was decided that under no circumstances it can be increased to more than 50 percent for the three categories SC, ST and OBC.
